Background
At the April 5th Scoping Meeting at the DPLU Hearing Room, the parking lot was closed to the public. I asked the Sheriff Deputy in charge and he said it was just a mistake by the private security firm hired by DPLU but later we were told that there was a bomb or a bomb threat.

Sup. Jacobs said the meeting was not subject to the Brown act, and further more, that citizens comments could not be made about the Blackwater project. She referenced a law that restricts interactions of supervisors during the processing of a development.

What is the law governing this sort of meeting
Recently, the county counsel received a ruling by Superior Court Judge Gail Andler regarding the decision by the San Diego Local Agency Formation Commission, regarding the vote by Dianne Jacob on the Home Depot proposal in El Cajon. According to that ruling, which supports the ability of Sup. Jacob to vote on the issue after having already expressed opposition to the project. The Judge said that the commission's decision was legislative, not judicial, meaning Jacob was able to vote, Deputy County Counsel Ellen Pilsecker said, according to the Union Tribune. Can you please help me request a copy of that decision (as I guess your office has probably received a copy of it). FYI, we think this will materially affect the ability of Sup. Jacob to express her opinion on a whole host of issues, including the Blackwater West project. Up till now, your office has blocked even public comment when the issue came up in the March 2007 Backcountry Revitalization Meeting. Please consider this a Public Records Request.

Request Name: Planning Group Conflict of Interest

Background
The PotreroPlanningGroup has demonstrated remarkable lack of analysis, some use Blackwater logo shirts, and the chair frequently speaks at other events in favor of the project despite petitions demonstrating a substantial objection to the project.
Additionally, members of the planning group have mentioned that Blackwater may have promised contributions to the community. According to Policy I-1, Page 7 of 21, it states that:
No planning or sponsor group member shall request any project proponent to make any contribution of money, goods, services, or any other things of value to the community or to any person or organization within the community...
We understand that Blackwater may have made a matching contribution to the Volunteer Fire Department at the recent "Celebrate America Day" picnic. I would think that accepting money, goods, or services from a proponent of a project would also be covered by this language, as it implies a request.

- Please provide the financial disclosures of all the members of the Potrero Planning Group.
- Has any planning group member received ANY contribution of money, goods, or services from Blackwater, to include T-Shirts, Hats, Signs, and other advertising displaying the Blackwater logo, as well as meals, travel expenses, or entertainment.
- Has Blackwater made contributions to local nonprofit groups to which the Planning Group members also are involved in some capacity, such as the Volunteer Fire Department, Kiwanis, etc.

Lori Spar was employed by the law firm hired by Blackwater and then in the next month, she was hired by the County DPLU to work on the Blackwater project. This represents an obvious conflict of interest.

- According to County Policy SS-19, "Employees are required to provide any outside employment or activities which relates to his/her County duties". Please provide any such disclosures by Lori Spar, and any other current or prior DPLU employees who were/are assigned to work on the Blackwater West project (P06-069)

Request Name: Jacob/Hunter meeting with Blackwater in May 2007

Background
According to the Union Tribune article by Anne Krueger of April 17, 2007, Sup. Jacob is quoted as saying that she met with Hunter and Blackwater at her office on May 23, 2007. She said they did not describe the site. However, she sent a fax to DPLU on May 11 which described the project in significant detail, including the location in Potrero. It seems that at a minimum, the details that were contained in the fax had to be discussed.

Request Name: No Penalties for substantial permit violations

Background
Covert Canyon was graded and modified, including adding an airport and helicopter landing zone. The county ordered them to stop operation, but the DPLU said they will not seek penalties. In our interview with the owner of the property, Mr. Marc Halcon, he stated that the County actually provided initial approval of the property, except for the grading, which was performed without a permit.

- How many people have been penalized during 2006 by the County for not seeking the proper permits for building, grading, or using a property contrary to its zoned use? Please provide the list of names and addresses and what the penalties were.
- Is there any licensing by the county of shooting ranges? Do you know if the State of California would perform such licensing?

Request Name: County removed trees in front of Lutz Residence with no notice.

Background
Trees in front of 1010 Old Chase were removed with no notice. If our trees are too close to the road or something, we expect at least a letter letting us know so we can move the trees or do what ever trimming might be necessary. The palm trees were between five and twelve feet in height, and were irrigated. We also had a decorative Sago palm tree ($50 value) and other plants that were ripped out. We noticed that this project was completed just after Raymond Lutz made a request for information from Sup. Jacob regarding the rules governing the Backcountry Revitalization meeting, apparently in retribution for making the request.
- Contacted Carlos Michel, vegetation manager. He said he approved the project.

- Were the trees ripped out to "teach Lutz a lesson" by Sup. Jacob or perhaps the County Counsel?
- Mr. Michel said the county would be willing to replace the trees, but nothing has been done.

Emil Susu had to vacate his seat on the Potrero Planning Group because was not registered to vote in CA. He corrected his voter registration and was reappointed by Group 5-10-2007 but needs approval by Board of Supervisors.
According to Policy I-1, Article II, Section IV, it states that
... Only upon appointment by the Board of Supervisors can the new candidate assume the responsibilities of membership.
However, the Potrero Planning Group continues to allow Emil Susu to sit with the board and carry on discussions as if he has already been confirmed.
Current Request
Please inform the Potrero Planning Group that Mr. Susu should not assume the responsibilities of membership, including being seated with the rest of the panel, until his confirmation by the Board of Supervisors is completed.

When you called our office the other day I believe you were also asking about some whether there was some sort of central location or list that would connect individuals and communities impacted by the fire with those offering to assist. There is not something that currently exists like that as each community is organizing in their own fashions with community groups such as churches, service groups or businesses have stepped up to offer assistance on a case by case or community by community basis. I figured this answer may not be as detailed as you wanted so I asked the County’s recovery folks for a bit more so that I can provide you with a better response. They said that 2-1-1 is currently the best source for residents to match donations with need. They have been connecting callers to appropriate organizations. In addition, the Local Assistance Centers might also have information available about needs or offerings as well.
I appreciate your continued investigation into this question. Who runs 2-1-1?
In response to you question about 211, it is a federally funded program that the County operates as an information line to the region regarding services, etc.
